Listserv Policy
The members of the listserv shall consist of members of AACDL. In extraordinary cases, non-AACDL members shall be included on a case by case basis as approved by the executive director.
1) Personal Affronts:
The use of personal insults, scornful language, or ridicule in addressing or describing any member of the Association will not be tolerated on the AACDL Listserv. Violation of this policy will subject the offending Listserv user to sanctions to be imposed by the Executive Committee. Such Sanctions may include limiting the user’s ability to post to the Listserv, temporary suspension, or permanent termination of the user’s Listserv privileges.
In extreme cases, the Executive Director and the President of the Association or, in their absence or the absence of either of them, two members of the Executive Committee, may direct the moderator or administrator of the Listserv to immediately restrict the offending user from posting messages until such time as the Executive Committee shall determine whether sanction is warranted. Not less than one week and not more than two weeks after electronic notice of referral to the Executive Committee has been forwarded to the user, the Executive Committee by majority vote shall determine whether there has been violation of this policy and, if so, impose the sanction it deems appropriate. Within the first week following notice of referral to the Executive Committee, the user may offer such explanation, defense, or request as she or he may have in the matter.
Further, if deemed appropriate by the Executive Committee, the matter may be referred to the Full Board to determine whether there has been such misconduct as would warrant censure of the user.
2) All listserv messages shall include the first and last names of the author.
3) In order to protect the integrity of the listserv and its members, no messages may be disseminated to anyone outside of AACDL without express permission of all authors.
4) No off topic discussion is permitted on the listserv. Any member may post an off topic question or message with “OT” in the subject line; however, responses to off topic posts must go privately to the originator of the thread and not to the entire listserv. Please remember to press REPLY and not REPLY ALL when responding to off topic messages.
5) As a nonprofit entity the Arkansas Association of Criminal Defense Lawyers is prohibited from endorsing any candidate for elected office. Members of this Association are free to express their personal preferences, but they cannot speak for AACDL or any element of AACDL on the candidacy of any person seeking elected office.
Members are encouraged to post their “successes” on the listserv; congratulatory reply messages should be sent privately rather than posted on the listserv. This creates a lot of unnecessary mail in everyone’s boxes.
Any member who violates listserv policy causing complaints will be subject to review by the executive director. The executive director may choose to place a member in violation onto moderated status.
